Summary of the final regulatory action:

It is prohibited to place on the market or use plant protection products containing 1,3-dichloropropene. 1,3-Dichloropropene is not included in the list of approved active substances under Regulation (EC) No 1107/2009 concerning the placing of plant protection products on the market, which replaces Directive 91/414/EEC.
A first decision not to include 1,3-dichloropropene in Annex I to Directive 91/414/EEC (i.e. the list of approved active substances) was adopted in 2007 (Commission Decision 2007/619/EC). The original applicant submitted a new application for approval of the active substance. A second decision (Commission Decision 2011/36/EU) confirmed the non-inclusion of 1,3-dichloropropene in the list of approved active substances in Annex I to Directive 91/414/EEC. No authorisations for plant protection products containing 1,3-dichloropropene are allowed to be granted by the Member States and all uses of plant protection products containing 1 ,3-dichloropropene are prohibited.

The reasons for the final regulatory action were relevant to: Human health and environment

Summary of known hazards and risks to human health:

It was concluded that it was not demonstrated that it may be expected that plant protection products containing 1,3-dichloropropene satisfy in general the requirements laid down in Article 5 (1) (a) and (b) of Directive 91/414/EEC.
1,3-Dichloropropene has a high acute oral and dermal toxicity and a .moderate inhalatory toxicity. The initial decision raised concerns about the consumer exposure since the information available was insufficient to satisfy the requirements set out in Annex 11 and Annex III Directive 91/414/EEC in particular with regard to a finalised assessment of consumer exposure. The additional information provided by the notifier for the second assessment did not permit elimination of the concern for consumer exposure in relation to 11 unidentified manufacturing process impurities.

Reduction of risk from the use of plant protection products containing 1,3-dichloropropene.

Summary of known hazards and risks to the environment:

It was concluded that it was not demonstrated that it may be expected that plant protection products containing 1,3-dichloropropene satisfy in general the requirements laid down in Article 5 (1 ) (a) and (b) of Directive 91/414/EEC.
The initial evaluation considered that the information available on the environmental fate and ecotoxicology of 1,3-dichloropropene and on its persistency, toxicological behaviour, uptake from crops, accumulation, metabolic fate and residue level of certain polychlorinated impurities was insufficient. It also raised concerns on:
- The potential contamination of groundwater;
- The risk to birds, mammals and aquatic organisms;
- The possible impact on non-target organisms.
The additional data and information provided in the second notification did not permit the elimination of all these concerns. The potential contamination of groundwater in relation to 1,3-dichloropropene, its relevant toxic breakdown product (EZ)-3-chloroacrylic acid and 11 unidentified manufacturing impurities was not adequately addressed. A potential for long-range transport through the atmosphere of 10 manufacturing impurities was also observed. Finally, the risk to non-target organisms was not demonstrated to be acceptable.

Date of entry into force of the final regulatory action: 21/01/2011

Entry into force of Commission Decision 2011/36/EU of 20 January 2011 is 21 January 2011. All uses of plant products containing 1,3-dichloropropene were prohibited as from that date at the latest.
